Eliminating Discrimination Based on Sex: Responses to Allegations of Sexual Misconduct
Florida Agricultural and Mechanical University (FAMU) promotes access to its educational programs and activities consistent with federal statutes; state regulations; and University regulations, policies and procedures. The University takes prompt action to investigate student complaints of sex discrimination pursuant to federal, state and local statutes.
Title IX of the Education Amendments of 1972 and its implementing regulations, prohibits discrimination on the basis of sex in educational programs or activities operated by recipients of Federal financial assistance. Title IX protects students from sexual harassment, which is one type of sex discrimination, which is prohibited by Title IX. The United States Department of Education, Office of Civil Rights, issued a “Dear Colleague” dated April 4, 2011. As of August 14, 2020, the Department of Education implemented a new regulation which affords additional due process rights for both parties.

The agency provides 24-hour access to a free, confidential hotline. 2-1-1 Big Bend is a private, telephone counseling, crisis intervention and referral services in Tallahassee. The agency provides a referral database on their website that includes human service information and assistances. They are available 24 hours a day to listen and provide emotional support, crisis counseling, suicide prevention, and information and referrals. You do not have to be in a crisis to call, there is no eligibility criteria, and their services are free. They help you navigate through the maze of community services in a non-judgmental manner.

Florida A&M University is committed to providing an educational and work environment free from discrimination and harassment on the basis of sex, sexual orientation, gender identity, and gender expression.
The purpose of this survey is to learn more about sexual, physical, or personal incidents you may have experienced during your matriculation at Florida Agricultural and Mechanical University (FAMU).
Sexual misconduct is any sexual activity that occurs without the clear, knowing and voluntary consent prior to and during such sexual activity, or that occurs when a person is unable to give consent.
A complaint of alleged discrimination and/or harassment may be filed by the affected individual pursuant to University Regulation 10.103. In order to initiate a formal complaint, the affected individual must complete a “Charge of Discrimination/Harassment” form (obtained from the Office of EOP) and return this form to the Office of Equal Opportunity Programs.

- Training all university law enforcement personnel on the University’s Title IX responsibilities and handling of sexual harassment or sexual misconduct complaints;
- Training all employees who interact with students regularly on recognizing and appropriately addressing allegations of sexual misconduct under Title IX;
- Training the Title IX Coordinator and any other employees who are involved in processing, investigating, or resolving complaints of sexual misconduct;
- Informing victims of their options to notify proper law enforcement authorities, and the option to be assisted by University employees in notifying those authorities;
- Designating an individual from the University’s counseling center to be “on call” to assist victims of sexual misconduct whenever needed;
- Offering counseling, health, mental health, or other holistic and comprehensive victim services to all victims affected by sexual misconduct, and notifying students of campus and community counseling, health, mental health, and other student services;
